Terms & Conditions

These terms govern your use of the NexAxe website and the purchase of our digital design, development, branding and automation services.

1. Agreement

By using the NexAxe website (nexaxe.com), submitting an enquiry, placing an order, or engaging our services, you agree to these Terms & Conditions and our Privacy Policy.

If you do not agree, please do not use our website or services.

2. About NexAxe

NexAxe provides professional digital services including websites, e-commerce stores, business systems, branding, content, social media support and AI automation for businesses in Sri Lanka and internationally.

3. Website use

You agree to use our website lawfully and not to:

  • Attempt to gain unauthorised access to our systems or data
  • Submit false, misleading or spam enquiries
  • Copy, scrape or redistribute site content without permission
  • Interfere with the normal operation or security of the website

Package prices, offers and timelines shown on the website are indicative and may be updated. Final pricing is confirmed in writing before work begins.

4. Enquiries and orders

Submitting a contact form or order form does not create a binding contract by itself. A project is confirmed only after:

  • We review your requirements
  • Scope, price and timeline are agreed in writing (email, WhatsApp or signed quote)
  • Any required deposit is received, where applicable

5. Packages, pricing and payment

Published packages on our packages page describe standard service tiers. Custom or premium projects may require a separate quote.

  • Unless otherwise agreed, a 50% deposit is required before work starts.
  • The remaining balance is due on delivery or as set out in your project agreement.
  • We accept PayPal, bank transfer and other payment methods as communicated after order confirmation.
  • Prices may be quoted in LKR or USD depending on your region and project scope.
  • Late payments may delay delivery or pause active work until accounts are settled.

6. Client responsibilities

To deliver your project on time, you agree to:

  • Provide accurate project information, content, logos and brand assets
  • Respond to feedback requests and approvals within agreed timeframes
  • Ensure you have rights to any content, images or materials you supply
  • Provide timely access to hosting, domains, platforms or accounts when needed

Delays caused by missing content, late approvals or third-party access issues may extend timelines and are not the responsibility of NexAxe.

7. Revisions and scope changes

Each package includes a defined level of design and development work. Requests outside the agreed scope—such as extra pages, features, integrations or redesigns—may require additional fees and revised timelines.

We will always discuss scope changes with you before proceeding with billable extra work.

8. Intellectual property

Upon full payment, you receive ownership or a licence to use the final deliverables created specifically for your project, as defined in your agreement.

  • NexAxe retains the right to showcase completed work in our portfolio, case studies and marketing unless you request otherwise in writing.
  • Pre-existing tools, frameworks, code libraries, fonts, stock assets or licensed components may remain subject to their original licences.
  • Until full payment is received, all work product remains the property of NexAxe.

9. Third-party services

Many projects rely on third-party platforms such as hosting providers, domain registrars, payment gateways, Shopify, email services or plugins. NexAxe is not responsible for outages, policy changes, pricing changes or account issues caused by third-party providers, though we will assist where reasonably possible.

10. Timelines and delivery

Stated delivery timelines are estimates based on package scope and timely client cooperation. We aim to meet agreed deadlines but cannot guarantee delivery dates affected by factors outside our control.

11. Warranties and support

We warrant that services will be performed with reasonable skill and care. After delivery, limited post-launch support may be included depending on your package. Ongoing maintenance, hosting, updates and marketing are separate unless explicitly included in your agreement.

12. Limitation of liability

To the fullest extent permitted by law, NexAxe is not liable for indirect, incidental or consequential losses including lost revenue, lost data or business interruption arising from use of our website or services.

Our total liability for any claim relating to a specific project is limited to the amount paid to NexAxe for that project, except where liability cannot be limited under applicable law.

13. Cancellation and refunds

If you wish to cancel a project after work has started, deposits may be non-refundable because they cover planning, design and reserved production time. Any refund or partial refund will depend on work completed and costs already incurred. We will discuss this fairly on a case-by-case basis.

14. Confidentiality

We treat client business information and project materials as confidential and do not disclose them to third parties except where required to deliver the service, comply with law, or with your permission.

15. Governing law

These terms are governed by the laws of Sri Lanka, unless otherwise agreed in writing for a specific international contract. Any disputes will first be addressed through good-faith discussion, and if unresolved, through appropriate legal channels in Sri Lanka.

16. Changes to these terms

We may update these Terms & Conditions from time to time. Updated terms will be posted on this page with a revised date. Continued use of the website after changes constitutes acceptance of the updated terms.
